Order Wizard™ Gold Club Rules

1.These Order Wizard Gold Club Rules ("Rules"), including the Arbutus Ridge Ltd, Privacy Policy for the Gold Club Programme govern the accumulation and use of Gold Club Points and set out the terms of the contract between Arbutus Ridge Ltd ("us/we") and each Gold Club Member. A Gold Club Member can register with the Order Wizard Gold Club programme ("Gold Club Programme") by registering on a website powered by Order Wizard and can then earn Gold Club Points on their purchases. We may refuse a registration for any good reason.

2.We will set up a Gold Club Account to record Gold Club Points earned or redeemed by each Gold Club Member at each website powered by Order Wizard. Each website powered by Order Wizard requires a separate registration and therefore a separate Gold Club account. Gold Club Points may not be consolidated or moved between Gold Club Accounts.

3.All Gold Club Members must be a UK, Channel Island or Isle of Man resident. Changes of address must be notified to us. All Gold Club Members must be over 18 years of age.

4.Arbutus Ridge Ltd. has a network of Restaurants that use Order Wizard to power their websites ("Restaurants") and through whom you earn Gold Club Points. We award Gold Club Points when one of our Restaurants tells us a Gold Club Member has completed a relevant transaction with them through their website. Through such a website, Gold Club Members can redeem Gold Club Points at a specific Restaurant in order to obtain goods and services or discounts ("Rewards"). Restaurants determine the particular transactions on which Gold Club Points can be earned and the number of Gold Club Points to be earned. There is a set number of Gold Club Points needed to obtain a Reward. We cannot control every specific change made by the Restaurant or their offers but we do try to ensure that while the Gold Club Programme is in operation, a range of offers is available.

5.All Rewards are subject to availability. Transactions on which Gold Club Points are earned or redeemed are made directly with the relevant Restaurant and we have no responsibility for the delivery, standard, quality or otherwise of any goods and services received or supplied or the failure of a Restaurant to honour a redemption or make a specific Reward available. These transactions and all Rewards are subject to all applicable legal rules and the terms and conditions (including booking requirements, cancellation restrictions, return conditions, warranties and limitations of liability) of the Restaurant. When Gold Club Points are redeemed, we may act as intermediary between the relevant Gold Club Member and the Restaurant and we will do what we can to ensure such Rewards are supplied by the relevant Restaurant. Our General Rewards Conditions will apply to any Rewards booked through an Order Wizard powered website or directly with the Restaurant.

6.Gold Club Points cannot be redeemed until credited to a Gold Club Member's Account. Restaurants will take different periods to notify us of the number of Gold Club Points to be credited. We are not responsible for a failure, delay or error by a Restaurant notifying us of Gold Club Points to be credited.

7.Gold Club Points expire after one year and they are lost if the relevant Gold Club Account is closed or if the Gold Club Programme ends at a specific Restaurant or otherwise. Where Gold Club Points are redeemed for a Voucher carrying a specified cash discount or benefit, the Voucher may have an expiry date specified on it and may be subject to any other terms and conditions stated on the Voucher or otherwise publicised.

8.Redeemed Gold Club Points cannot be used again. If a transaction on which gold Club Points are issued or redeemed is cancelled, reversed or not completed, we will reverse the associated Gold Club Points movement when instructed by the relevant Restaurant. If insufficient Gold Club Points are available, or we suspect fraud or misconduct, Rewards may be refused or cancelled.

9.A Gold Club Member who continues to collect Gold Club Points may log into their Gold Club Account to see their current Gold Club Points balance. We will correct a Gold Club Account if it is shown to our reasonable satisfaction to be wrong but, unless there are clear records showing this, our decision is final.

10.Gold Club Points are personal to each Gold Club Account at each Restaurant and cannot normally be transferred. Gold Club Points can only be transferred from one Gold Club Account to another Gold Club Account on death or divorce if adequate evidence of the legal division of Gold Club Points is given to us.

11.Gold Club Points can only be earned, held, transferred or redeemed as set out in these Rules. Any other use, award, sale, exchange or transfer of Gold Club Points, or attempt to do so, is a serious breach of these Rules. Any Gold Club Points not earned and held in accordance with these Rules will be invalid and cannot be redeemed for Rewards. Any such Gold Club Points on a Gold Club Account will be deducted and, if they are redeemed, we will ask the Restaurant to cancel the relevant Rewards and we may take other appropriate action. Gold Club Points from more than one Gold Club Account cannot be combined to redeem for the same Reward. Gold Club Points have no cash value.

12.Our Privacy Policy (which is part of these Rules) sets out the information that we will gather on Gold Club Members, how a Gold Club Member uses his/her Gold Club Account and earns and redeems Gold Club Points, how this information will be used and who it may be shared with. It is included on every registration form, on certain other materials we publish and is available from us. We will comply with our Privacy Statement - every Gold Club Member should read it carefully. If for any reason we need to transfer personal information outside the European Union for a specific purpose, we will ensure that it is treated to UK standards.

13.Vouchers should be treated like cash. We cannot be responsible for any unauthorised use of Gold Club Points or any lost or stolen Vouchers.

14.We may close any Gold Club Account on which no Gold Club Points have been earned or redeemed for a continuous period of at least 12 months. We may also immediately suspend or terminate the rights of any Gold Club Member and/or close any relevant Gold Club Account, if they breach these Rules, if we reasonably believe that they have dealt with Gold Club Points in a manner not permitted by these Rules or any applicable Restaurant's terms and conditions, if there is any theft from or misconduct in connection with us or any Restaurant, if they supply false or misleading information to us or if they are abusive or offensive to any member of our staff. A Gold Club Member may close his/her Gold Club Account at any time by notifying us. If a Gold Club Account is closed, everyone's rights to redeem Gold Club Points from that Gold Club Account are lost.

15.We may make and are entitled to make changes to these Rules as and when we see appropriate. Gold Club Members are therefore encourages to refer to them regularly when they login to their Gold Club Account. Earning or redeeming Gold Club Points on a Gold Club Account will constitute acceptance of the revised Rules. We may suspend or terminate the Gold Club Programme but will give as much notice as we reasonably can before we do so. If this happens all Gold Club Accounts will be suspended or terminated. If we sell or transfer the Gold Club Programme to another company, we may transfer all of our rights and obligations under these Rules without any further consent required by you, the Gold Club Member and we may disclose or transfer all information we hold about Gold Club Member to a prospective or actual new owner. Such a disclosure or transfer will not alter the rights of such Gold Club Members in respect of the use that can be made of such information by such other company.

16.Our only responsibilities with respect to the Gold Club Programme are set out in these Rules which are subject to English law. We will only be liable to a Gold Club Member who suffer loss as a result of our breach of these Rules and, if so, our sole liability will be to credit to the relevant Gold Club Account any Gold Club Points which have been wrongly deducted or should have been credited but were not. These Rules shall not exclude or limit our liability for death or personal injury caused by our negligence. These Rules prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials.

What information will we use?
As a participant in Gold Club Programme, we will collect and use information about you. This information includes your registration details, information about the use of your Gold Club Account, shopping purchases and other information that you give us (together "your information").

Who will we share your information with?
We will only share your information within the Arbutus Ridge Ltd. group, as appropriate, and with companies and/or Restaurants participating in Gold Club Programme and/or their group of companies.

How will your information be used?
We and the companies we share your information with may analyse and use your information to see where and how you use your Gold Club Account and to understand better your shopping behaviour. We and they will also use your information to select and send you Gold Club Point offers and other information on offers, products or services which are more likely to be of interest to you.

How do I check or change my marketing preferences?
You can check or change your marketing preferences at any time by logging into your Gold Club Account.

General reward conditions

These General Rewards Conditions apply in conjunction with the Rules to any redemption of Gold Club Points by a Gold Club Member for a Reward. Some rewards are voucher based and additional terms and conditions apply as stated in section I and II below. These are in addition to the individual terms and conditions specified in section III and IV, if applicable.

I. Gold Club Vouchers

These terms are in addition to the terms and conditions on the back of the voucher and below. Only original vouchers will be accepted. Damaged, defaced or photocopied vouchers will not be accepted. Once your Gold Club Points have been redeemed for vouchers, they cannot be exchanged back into Gold Club Points. Any vouchers sent to suppliers of Rewards should be sent by recorded delivery. Neither we nor our Restaurants are responsible for vouchers lost in the post. Once any vouchers have been used for a Reward, they will not be returned if you cancel.

Each voucher is issued by Arbutus Ridge Ltd. through the Gold Club Programme and is subject to the Rules of the Gold Club Programme. Each voucher represents the number of Gold Club Points shown on its face. Each voucher can only be used to obtain goods and/or services from authorised Restaurant by handing it over or submitting a unique code to the Restaurant at the time of purchase. Vouchers can be used as part payment and so if the price of the goods and/or services exceeds this value, the balance must also be paid on purchase. If the price of the goods and/or services is less than this value, no change will be given (unless the Restaurant states otherwise). Vouchers remain the property of Arbutus Ridge Ltd. Each Voucher is not valid beyond the expiry date shown on its face. Vouchers cannot be redeemed for cash nor sold or transferred for value.

II. Offer specific Gold Club Account vouchers

Voucher is to be handed to the Restaurant at the time of purchase and, if all conditions are met, you will be entitled to the specified reward. Voucher is only valid for the reward specified on the voucher. Voucher is not valid beyond the expiry date shown. Gold Club Points will not be refunded for vouchers not used by their expiry date. Voucher is not transferable and cannot be exchanged for cash and/or used with any other offer or promotion. Vouchers are non refundable. Damaged, defaced or photocopied vouchers will not be accepted. Vouchers remain the property of Arbutus Ridge Ltd. Vouchers are issued by Arbutus Ridge Ltd. and are subject to the Rules of the Gold Club Programme. Any voucher sent to suppliers of Rewards should be sent by recorded delivery. Neither we nor the Reward suppliers are responsible for vouchers lost in the post. In addition to the above, each offer specific voucher is subject to offer specific terms and conditions.
